What Does the Employee Free Choice Act Do?

There is a lot of talk about unions, their rights, and how things are going with the American worker nowadays. The EFCA made it easier for people to be able to connect with their representatives, made it quicker to work out what needed to happen in different cases and made it so that people can understand their rights.

Employers Cannot Demand National Labor Relations Board (NLRB) Elections

Employers used to be able to require NLRB elections because it made a difference in how they were able to run their companies and the unions associated with their companies. Now, they can’t demand these – it’s up to employees and their unions to sort out whether or not they want these elections to be held at any point in time.

Arbitrators are Required for Contract Negotiations

In the past, employers could work out “first contract” negotiations in good faith – but now, that isn’t the case at all. When the EFCA was passed, it required arbitrators to get involved after the first 30 days instead of after the first 90 days, which is a huge difference. It allows people in unions to get what they need from employers and makes it easier for employees to get back to work if they’re in a situation where they have been striking for a while.

Employers Who Practice Unfair Labor Practices Are Treated More Harshly

Lastly, the EFCA was developed in a way that changed unfair labor practice punishments for employers. They used to have to “make whole” and fix what they did wrong, but after the EFCA, it made it so that they had to pay back triple, depending on what happened, what was involved and who was involved in it. That’s a huge difference for everyone that is involved, and it makes it that much more difficult for employers to try and “get away with” unfair labor practices of all types. Instead, they have to watch their backs and, if they get caught, it could bring the whole company down as a result, which is much more of a deterrent.
